These terms and conditions set out the basis on which you may use the WM101 website and the general terms that apply to the waste management services we provide. Please read them carefully. By using this website you accept these terms.

Who we are

This website is operated by WM101 Ltd, a company registered in England and Wales under company number 08882889. References to “we”, “us” and “our” in these terms mean WM101 Ltd.

Using this website

You may use this website for lawful purposes only. You must not use it in any way that breaches applicable law, is fraudulent, or seeks to harm or attempt to harm the website, our systems or any other user. We do not guarantee that the website will always be available or free from errors, and we may suspend, withdraw or restrict access to all or part of it at any time.

The content on this website is provided for general information only. It does not constitute advice on which you should rely, and it is not a substitute for professional guidance on your specific waste, environmental or legal obligations.

Quotations and service agreements

Any quotation we provide is an invitation to treat and does not constitute a binding offer. Quotations are based on the information you supply about your waste types, volumes, site access and collection frequency, and are valid for the period stated on the quotation. A contract comes into effect only when we confirm your order in writing or begin providing services, whichever happens first.

Where you enter into a separate written service agreement with us, that agreement takes precedence over these terms in the event of any conflict.

Your duty of care

Under the Environmental Protection Act 1990 and associated regulations, you hold a duty of care in respect of the waste your business produces. You remain responsible for describing your waste accurately, for segregating it correctly, and for ensuring it is stored safely and securely before collection.

You agree to provide us with accurate information about the nature and composition of your waste, and to notify us promptly of any change. We will issue waste transfer notes or consignment notes as required, and you agree to retain your copies for the periods required by law.

Non-conforming waste

You must not place in any container we supply any waste that falls outside the agreed waste stream, including hazardous waste, clinical waste, liquids, asbestos, gas cylinders, batteries or electrical items, unless these have been expressly agreed with us in advance.

Where a container presents non-conforming waste, we may refuse collection, remove the contamination, or collect and dispose of the load as a different waste type. Additional charges may apply, and we will tell you about these where reasonably practicable before they are incurred.

Containers and equipment

Containers, balers, compactors and other equipment we supply remain our property at all times unless expressly agreed otherwise in writing. You agree to keep equipment in good condition, to use it only for its intended purpose, and to notify us of any damage, loss or theft. You are responsible for loss or damage arising from misuse, overloading or failure to secure equipment, other than fair wear and tear.

Site access and collections

You are responsible for ensuring safe and unobstructed access to containers at the agreed collection times. Where we are unable to complete a collection because access is blocked, a container is overloaded, or a vehicle cannot safely reach the collection point, we may charge a reasonable abortive call charge.

We will use reasonable endeavours to collect on the agreed schedule, but collection times are estimates. We are not liable for delays caused by matters outside our reasonable control, including severe weather, traffic conditions, site closures or disposal facility restrictions.

Charges and payment

Charges are as set out in your quotation or service agreement and are exclusive of VAT unless stated otherwise. Unless agreed otherwise, invoices are payable within the period stated on the invoice. We reserve the right to charge interest on overdue sums in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

We may vary our charges where disposal costs, landfill tax, statutory levies or fuel costs change, or where the volume, weight or composition of your waste differs materially from that on which the quotation was based. We will give you reasonable notice of any change.

Intellectual property

All intellectual property rights in this website and its content, including text, images, graphics and logos, belong to us or our licensors. You may print or download extracts for your own internal business use, but you must not reproduce, distribute or exploit any part of this website commercially without our written permission.

Links to other websites

Where this website contains links to third party websites, those links are provided for information only. We have no control over the content of those sites and accept no responsibility for them or for any loss arising from your use of them.

Our liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

Subject to the paragraph above, we will not be liable to you for any loss of profit, loss of business, business interruption, loss of anticipated savings or any indirect or consequential loss, and our total liability in connection with the services will not exceed the charges paid by you in the twelve months preceding the event giving rise to the claim.

Because our services are supplied to businesses, the provisions of consumer law that would otherwise apply to a contract with a consumer do not apply.

Data protection

We process personal data in accordance with our privacy policy, which explains what we collect, how we use it and the rights you have over your information.

Changes to these terms

We may amend these terms from time to time. The version published on this page is the version that applies to your use of the website. Please check this page periodically so that you are aware of any changes.

Governing law

These terms and any dispute arising out of or in connection with them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
